Please read these Terms of Use carefully before using the Premarket website or downloading our mobile app. By accessing or using our platform, you agree to these Terms of Use as well as our Privacy Policy. If you do not agree to these terms, please discontinue use immediately.

1. Acceptance of Terms

By using Premarket, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use. These terms may be updated at our sole discretion, and your continued use of the platform signifies your acceptance of any modifications.

2. Description of Services

Premarket is an online platform that facilitates connections between property owners and potential buyers. Homeowners can list their properties at no charge, while buyers may be required to subscribe to initiate contact. We act solely as a facilitator and do not provide real estate brokerage services.

3. App Store & Third-Party Compliance

Our app is available for download on the Apple App Store and Google Play Store. By downloading and using the app, you agree to adhere to the respective terms, conditions, and policies of these platforms, in addition to our own terms.

4. Subscription Terms

Access to certain features of Premarket, such as initiating contact with property owners, may require a yearly auto-renewable subscription. This subscription is billed annually through your App Store or Play Store account and renews automatically unless canceled at least 24 hours before the end of the current period.

You can manage your subscription, cancel anytime, or restore previous purchases directly through your device’s subscription settings. Canceling a subscription will take effect at the end of the current billing cycle.

No refunds or partial reimbursements are provided for unused portions of the subscription term. Features accessible through the subscription may be updated, removed, or modified at any time.

5. User Responsibilities and Acceptable Use

You are solely responsible for the accuracy and legality of the content you post. In using the Premarket platform, you agree to:

  • Provide accurate and complete information when listing your property.
  • Avoid using foul language or posting images, videos, or other content that is obscene, offensive, or otherwise inappropriate.
  • Refrain from engaging in any conduct that may harm or disrupt the platform, other users, or third parties.
  • Respect intellectual property rights and avoid posting any content that infringes on the rights of others.

We reserve the right to remove any content or suspend user accounts at our sole discretion and without prior notice.

6. Content Ownership and Intellectual Property

All content on Premarket, including text, images, logos, and software, is owned by Premarket or its licensors and is protected by applicable intellectual property laws. Unauthorized use, reproduction, or distribution of this content is strictly prohibited.

7. Payment and Fee Structure

Listing your property on Premarket is free. Buyers, however, may need an active subscription to contact sellers. These fees are designed to ensure genuine interest and discourage spam. Payment processing is handled securely via third-party providers in compliance with their respective terms and conditions.

8. Limitations, Disclaimers, and No Guarantees

Premarket is provided on an “as is” basis without any warranties, express or implied. We do not guarantee:

  • That the platform will operate without interruption or error.
  • The accuracy, reliability, or timeliness of any information provided.
  • Any sale, connection, or negotiation success between buyers and listers.
  • That users will not encounter spam or fraudulent activity.

Both buyers and property owners engage with the platform at their own risk. Premarket is not responsible for any loss, damage, or dispute arising from the use of our services.

9. Moderation and Content Removal

We strive to maintain a high-quality platform and actively moderate content to minimize spam and fraudulent activity. Despite our best efforts, we cannot guarantee the complete prevention of inappropriate or unsolicited content. Users are encouraged to report any suspicious or inappropriate behavior.

We reserve the right to remove any content or terminate user accounts at our discretion without prior notice.

10. Platform Role and Limitations

Premarket is strictly a facilitator of connections between property owners and prospective buyers. We are not a real estate agency and do not act as agents, brokers, or legal representatives. All negotiations, offers, and agreements are conducted solely between the users.

11. Opportunities for Upgrades

While listing your property is free, we may offer optional premium features or upgrades in the future. These additional services will be clearly described at the time of purchase and will be subject to separate terms and conditions.

12. Indemnification

You agree to indemnify, defend, and hold harmless Premarket, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising out of or related to your use of the platform, your violation of these Terms, or your infringement of any third-party rights.

13. Modifications to Terms

Premarket reserves the right to modify these Terms of Use at any time, with or without notice. Any changes will be posted on this page, and your continued use of the platform after such modifications constitutes your acceptance of the new terms.

14. Governing Law and Dispute Resolution

These Terms of Use shall be governed by and construed in accordance with the laws of the applicable jurisdiction, without regard to its conflict of law provisions. Any disputes arising from these terms or your use of the platform shall be resolved in accordance with the applicable legal procedures.

  • Any unauthorized access to or alteration of your transmissions or data;
  • Any conduct or content of any third party on the platform;
  • Any content obtained from the platform; or
  • Any other matter relating to the platform.
